After the arrest of Moussa Tchangari, member of the Frantz Fanon Foundation board, and other members of the social movement in Niger, the Foundation published a text -english and french- that can be read on its website http://frantzfanonfoundation-fondationfrantzfanon.com/article2418.html 

The Frantz Fanon also initiated a petition on the change.org website to demand the release of all those arrested.
Circulate these two informations and especially sign and above all have the petition signed. Our comrade Moussa Tchangari must be freed and all charges against him cancelled.

Le 25 mars 2018, Moussa Tchangari, membre du bureau de la Fondation Frantz Fanon et secrétaire général d’Alternatives Espaces Citoyens, organisation membre du Conseil international du Forum social mondial, Ali Idrissa, coordinateur du Réseau des organisations pour la transparence et l’analyse budgétaire (ROTAB), Nouhou Arzika, président du mouvement patriotique pour une citoyenneté responsable (MPCR) et Lirwana Abdourhamane, avocat et membre du MPCR, ont été arrêtés pour avoir appelé à une journée de mobilisation appelant à l’abrogation de la loi de finances 2018, dénoncée comme antisociale et injuste. S’appliquant depuis janvier 2018, cette loi favorise l’installation des transnationales au Niger alors que les citoyens sont de plus en plus soumis à une pression fiscale qui les précarise. Le groupe de presse Labari a été perquisitionné et fermé ; depuis le tribunal a ordonné sa réouverture.

La manifestation, faisant suite à plusieurs autres qui se sont toujours déroulées dans le calme et sans aucune violence, a été interdite pour raisons de sécurité ; pourtant la Constitution du 25 novembre 2010 garantit les libertés d'association, de réunion, de cortège et de manifestation dans les conditions définies par la loi (article 32) et le même jour, le parti présidentiel, le PNDS Tareyya, tenait à Niamey son congrès.

Moussa Tchangari, Ali Idrissa, Nouhou Arzika, Lirwana Abdourhamane, bien que n’ayant pas participé à la marche, restent incarcérés et sont accusés, par le Tribunal de Grande Instance de Niamey, d’avoir organisé cette manifestation, de complicité d’acte de violence, d’agression et de destruction de biens publics. L’arrestation de membres du mouvement social et l’envoi de certains d’entre eux, dont Moussa Tchangari, dans  des prisons éloignées à plus de 100 km de la capitale mais aussi dans des zones où sévit l’état d’urgence et qui ont été la cible de plusieurs attaques extrémistes, marquent une nouvelle étape de la dérive autoritaire du gouvernement nigérien, entre autres par la violation de certains droits fondamentaux et par le refus d’écouter la voix du peuple nigérien.

L’interdiction de cette manifestation montre une fois de plus que certains Etats privilégient la mise en place de politiques sécuritaires plutôt que de se conformer à leurs obligations contenues dans les dispositions de la Déclaration universelle des droits de l’Homme et dans les instruments régionaux et internationaux relatifs aux droits de l’Homme qu’ils ont ratifiés. Dès lors, ils n’hésitent pas à criminaliser les membres du mouvement social luttant pour les droits fondamentaux.

Nous rappelons que les autorités nigériennes doivent se conformer aux dispositions de la Déclaration sur les défenseurs des droits de l’Homme, adoptée par l’Assemblée générale des Nations unies le 9 décembre 1998, et plus particulièrement à son article 1 qui stipule que “chacun a le droit, individuellement ou en association avec d’autres, de promouvoir la protection et la réalisation de tous les droits de l’Homme et de toutes les libertés fondamentales aux niveaux national et international” et son article 12.2 qui prévoit que “l’Etat prend toutes les mesures nécessaires pour assurer que les autorités compétentes protègent toute personne, individuellement ou en association avec d’autres, de toute violence, menace, représailles, discrimination de facto ou de jure, pression ou autre action arbitraire dans le cadre de l’exercice légitime des droits visés dans la présente Déclaration”.

Nous appellons à la libération de Moussa Tchangari, d’Ali Idrissa, de Nouhou Arzika, et de Lirwana Abdourhamane, et à l'abandon de​ toute​s ​les ​charges ​pesant ​contre eux.

Since March 25th, 2018, Moussa Tchangari, a member of the Board of the Fanon Foundation and General Secretary of “Alternatives Espaces Citoyens,” an organization that is a member of the International Council of the World Social Forum, has been imprisoned by security forces for having called, with Ali Idrissa, coordinator of the Réseau des Organizations Pour la Transparence et L’analyse Budgétaire (ROTAB), Nohou Arzika, president of the Mouvement Patriotique por un Citoyenneté Responsable (MPCR), and Lirwana Abdourhamane, lawyer and member of the MPCR, to a day of mobilization calling for the end of the law of finances of 2018, denounced as antisocial and unjust. Applicable since January of 2018, this law is in favor of the installation of transnationals in Niger while the citizens of the country are increasingly submitted to a fiscal pressure that puts them in a precarious position. 

The Labari press group has been searched and closed, after which the tribunal ordered its reopening. 

The manifestation, which followed several others that always took place in calm and without violence, was prohibited for security reasons—however, the Constitution of November 25, 2010 guarantees the liberties of association, assembly, of procession and demonstration within the conditions defined by law (article 32)—, and the same day, the presidental party, le PNDS Tareyya, had its meeting in Niamey.

Even though Moussa Tchangari, Ali Idrissa, Nouhou Arzika, Lirwana Abdourhamane did not participate in the march, they are accused by the Tribunal de Grande Instance of Niamey of having organized the manifestation, of being complicit with acts of violence, and of aggression and destruction of public goods.   

The arrest of members of the social movement and the imprisonment of some among them, including Moussa Tchangari, in prisons that are located more than 100km from the capital, and in zones that find themselves in a state of emergency and that are the target of several extremist attacks, marks a new stage of the authoritarian tendency of the goverment of Niger, caused by, among other things, the violation of certain fundamental rights and by the refusal of listening to the voice of the people of Niger. 

The prohibition of the manifestation demonstrates once more that certain states privilege the establishment of politics of securitization over their adherence to the obligations that are part of the Universal Declaration of Human Rights and of the regional and international instruments that have been ratified. From there that they do not hesitate in criminalizing the members of social movements that fight for fundamental rights. 

The Frantz Fanon Foundation is troubled that one of its members, but also the other members of the social movement, have been arrested arbitrarily, and underlines that this is not the first time that Moussa Tchangari faces accusations that do not have any proof, and that he is the object of harrasment by the police and the courts. 

The juridical harrasment and the violence of the police towards the protesters shows that the government only seeks to bury and to muzzle all opposition to the law of finance that increasingly puts citizens of Niger in great precarity. 

The Foundation reiterates that the authorities of Niger should follow the dispositions of the Declaration on the rights and responsibilities of defenders of human rights, adopted by the General Assembly of United Nations on December 9, 1998, and more particularly of its article 1 which estipulates that “Everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels” and of its article 12.2 which asserts that “The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of rights referred to in the present Declaration."

Aware of the danger that the trivialization of police practices constitutes for the public life of the country, the Frantz Fanon Foundation calls for the liberation of Moussa Tchangari, Ali Idrissa, Nouhou Arzika, and of Lirwana Abdourhamane, and for dropping all charges against them.
