 *Algérie : Les autorités doivent cesser le harcèlement des militants du
droit au travail*



*Copenhague-Paris-Genève, le 13 mars 2015* *- Le Réseau Euro-méditerranéen
des Droits de l’Homme (REMDH) et l'Observatoire pour la protection des
défenseurs des droits de l'Homme, programme conjoint de la FIDH (Fédération
internationale des ligues des droits de l’Homme) et de l’Organisation
mondiale contre la torture (OMCT),* *dénoncent les graves atteintes au
droit à un procès équitable lors de la dernière audience contre neuf
militants du Comité National pour la Défense des Droits de Chômeurs
(CNDDC),* *qui s’est tenue le 11 mars 2015 à Laghouat (400 km au sud
d’Alger). *



Ce jour-là, une présence policière disproportionnée a été déployée
empêchant le public et les témoins de la défense d'entrer dans la salle
d’audience, ce qui constitue une violation des droits de la défense et du
droit à un procès équitable. À l’extérieur du tribunal, une cinquantaine de
manifestants pacifiques ont par ailleurs été arrêtés alors qu’ils
exprimaient leur solidarité avec les neuf détenus. Tous ces manifestants
été relâchés par la suite. Afin de protester contre ces entraves, le
collectif des avocats de la défense a alors décidé de se retirer.
L’audience en appel de M. *Mohamed Rag* a été reportée au 18 mars 2015 ;
celle concernant les autres huit militants, MM. *Khencha Belkacem*, *Brahimi
Belelmi*, *Mazouzi Benallal*, *Azzouzi Boubakeur*, *Korini Belkacem*,
*Bekouider
Faouzi*, *Bensarkha Tahar* et *Djaballah Abdelkader*, a été fixée au 25
mars 2015.



Ces derniers, détenus depuis le 28 janvier 2015, ont été condamnés en
première instance le 11 février à un an de prison ferme dont six mois avec
sursis et à 5 000 dinars algériens d’amende chacun, pour « *attroupement* »
(art. 97 du Code pénal), et pour avoir exercé une « *pression sur les
décisions des magistrats* » (art. 147 du Code pénal). M. Mohamed Rag, en
détention depuis le 22 janvier 2015, a été condamné le même jour à 18 mois
de prison ferme et 20 000 dinars algériens d’amende pour « *violences
envers agent de la force publique *» (art. 148 du Code pénal). Nos
organisations ont déjà dénoncé à plusieurs reprises les conditions de leur
arrestation et de leur détention, qui ne semblent motivées que par leurs
activités de défense des droits de l’Homme.



Nos organisations condamnent par ailleurs la multiplication de cas de
harcèlement judiciaire qui semblent viser d'autres militants,
notamment M. *Rachid
Aouine* ainsi que trois autres membres du CNDDC de la ville d’El Oued (620
km au sud-est d’Alger). M. Aouine a été condamné en première instance le 9
mars 2015 par le Tribunal de la ville à six mois de prison ferme et à 50
000 dinars algériens d’amende, pour « *incitation à attroupement non armé* »
en vertu de l’article 100 du Code pénal, suite à un commentaire publié sur
sa page Facebook dans lequel il exhortait les policiers à défendre leurs
droits au lieu de réprimer les manifestants. M. *Abdelhamid Brahimi*, qui
avait critiqué la police d’El Oued sur Facebook suite aux arrestations
musclées des membres de la famille de M. Rachid Aouine qui s’étaient
rassemblés pacifiquement pour demander sa libération le 3 mars, a été
arrêté le même jour et poursuivi pour «* incitation à attroupement* » sur
la base de ses commentaires sur ce réseau social. Il a finalement été
relaxé le 9 mars. Enfin, MM. *Ferhat Missa* et *Youssef Sultani* ont été
arrêtés respectivement les 1er et 3 mars 2015 puis libérés. Ils seront
jugés les 16 et 19 mars prochains pour « *incitation à attroupement* »,
pour avoir participé à des manifestations pacifiques à El Oued.



Nos organisations demandent aux autorités algériennes de :



·         Libérer de manière immédiate et inconditionnelle MM. Rachid
Aouine, Mohamed Rag, Khencha Belkacem, Brahimi Belelmi, Mazouzi Benallal,
Azzouzi Boubakeur, Korini Belkacem, Bekouider Faouzi, Bensarkha Tahar et
Djaballah Abdelkader, en ce que leur détention ne semble viser qu’à
sanctionner leurs activités de défense des droits de l’Homme ;



·         Mettre fin à tout acte de harcèlement à l'encontre de tous les
défenseurs susmentionnés, y compris au niveau judiciaire, conformément aux
dispositions de la Déclaration des Nations unies sur les défenseurs des
droits humains ;



·         Garantir le droit à un procès équitable et assurer les garanties
élémentaires des droits de la défense, conformément à l'article 14(3) du
Pacte international relatif aux droits civils et politiques (PIDCP),
ratifié par l’Algérie ;



·         Garantir l’exercice des libertés de réunion, d’association et
d’expression, conformément à la Constitution algérienne et aux dispositions
du PIDCP.

*الجزائر: **على السلطات وقف المضايقات التي تستهدف ال**ناشطين في مجال الدفاع
عن الحق في العمل*



*كوبنهاغن-باريس-جنيف، *13* مارس/آذار *2015* – إن الشبكة** الأوروبية -
المتوسطية لحقوق الإنسان ومرصد حماية المدافعين عن حقوق الإنسان، **ال**برنامج
مشترك بين الفدرالية الدولية لحقوق الإنسان (**FIDH**) والمنظمة العالمية
لمناهضة التعذيب (**OMCT**)، يشجبان الانتهاكات الخطيرة للحق في محاكمة عادلة
التي سجّلت أثناء جلسة الاستماع الأخيرة للدعاوى المرفوعة ضد تسعة ناشطين من
اللجنة الوطنية للدفاع عن حقوق البطالين (**CNDDC**) والتي عقدت في **11**
مارس/آذار **2015** في الأغواط (**400** كلم جنوب العاصمة الجزائرية).*



تمّ في ذلك اليوم نشر عدد هائل وغير متناسب من عناصر الشرطة لمنع عامة الناس
وشهود الدفاع من دخول قاعة المحكمة، الأمر الذي يشكّل انتهاكاً لحقوق الدفاع
والحق في محاكمة عادلة. كما ألقي القبض خارج المحكمة على خمسين متظاهراً كانوا
قد تجمعوا بشكل سلمي للتعبير عن تضامنهم مع الموقوفين التسعة، ليُصار إلى
الإفراج عنهم جميعاً في وقت لاحق. واحتجاجاً على هذه التصرفات والعقبات، قرر
فريق محامي الدفاع الانسحاب من قاعة المحكمة. فتم تأجيل الجلسة المتعلقة
بقضية *محمد
رق* إلى 18 مارس/آذار 2015؛ أما الجلسة للنظر في قضايا الناشطين الثمانية
الآخرين، السادة *خنشة بلقاسم* و*براهيمي بلعلمي *و*مازوزي بن علال *و*عزوزي
بوبكر *و*كوريني بلقاسم *و*بلقويدر فوزي *و*بن صرخة الطاهر *و*جاب الله عبد
القادر*، فتعينت في 25 مارس/آذار 2015.



وكان قد حكم على هؤلاء الناشطين، الموقوفين منذ 28 يناير/كانون الثاني 2015،
خلال جلسة محاكمتهم في 11 فبراير/شباط بالسجن لمدة سنة وستة أشهر مع وقف
التنفيذ ودفع غرامة بقيمة 5،000 دينار جزائري بتهمتي "*التجمهر*" (المادة 97
من قانون العقوبات) و"*التأثير على أحكام القضاة*" (المادة 147 من قانون
العقوبات). أما محمد رق، المحتجز منذ 22 يناير/كانون الثاني 2015، فحكم عليه
في اليوم نفسه بالسجن لمدة 18 شهراً ودفع غرامة بقيمة 20،000 دينار جزائري
بتهمة "*التعدي بالعنف على أحد الضباط العموميين في مباشرة أعمال وظائفه*"
(المادة 148 من قانون العقوبات الجزائري). وقد سبق للمنظمتين التنديد بشكل
متكرر بظروف اعتقالهم واحتجازهم التي يبدو وكأنها لا تهدف سوى إلى معاقبة
نشاطهم في مجال الدفاع عن حقوق الإنسان.



كما وتدينن منظماتنا  شيوع حالات المضايقات القضائية التي تستهدف عل ما يبدو
ناشطين آخرين، بما في ذلك السيد *رشيد عوين* وثلاثة أعضاء آخرين من اللجنة
الوطنية للدفاع عن حقوق البطالين (CNDDC) في مدينة الوادي (620 كلم جنوب شرق
الجزائر العاصمة). وكان قد حكم على السيد عوين أثناء محاكمته في 9 مارس/آذار
2015 في مدينة الوادي بالحبس لمدة ستة أشهر ودفع غرامة بقيمة 50،000 دينار
جزائري، وذلك بتهمة "*التحريض على التجمهر غير المسلح*" بموجب المادة 100 من
قانون العقوبات الجزائري، إثر تعليق نشره على صفحته على موقع التواصل
الاجتماعي "فيس بوك"، حثّ فيه الشرطة على الدفاع عن حقوق المتظاهرين بدلاً من
قمعهم. أما السيد *عبد الحميد ابراهيمي*، الذي كان قد وجّه انتقادات لشرطة
الوادي على موقع التواصل الاجتماعي "فيس بوك" إثر عمليات الاعتقال العنيفة
التي استهدفت أفراد أسرة رشيد عوين أثناء تجمعهم بشكل سلمي للمطالبة بالإفراج
عنه في 3 مارس/آذار، فتم اعتقاله في اليوم نفسه وتمت محاكمته بتهمة "*التحريض
على التجمهر*"، وذلك على خلفية تعليقاته هذه. وقد أطلق سراحه أخيراً في 9
مارس/آذار. كما ألقي القبض على كل من السيدين *فرحات ميسى* و*يوسف سلطاني * في
1 و3 مارس/آذار 2015 على التوالي ليتم الإفراج عنهما لاحقاً. وسيتم إصدار
الحكم عليهما في 16 و19 مارس/آذار بتهمة "*التحريض على التجمهر*"، وذلك على
خلفية مشاركتهما في مظاهرات سلمية في الوادي.



تطالب منظماتنا السلطات الجزائرية بـ:



*·          *إطلاق سراح كل من السادة رشيد عوين ومحمد رق خنشة بلقاسم
وبراهيمي بلعلمي ومازوزي بن علال وعزوزي بوبكر وكوريني بلقاسم وبلقويدر فوزي
وبن صرخة الطاهر وجاب الله عبد القادر، وذلك على الفور ومن دون قيد أو شرط، إذ
أن احتجازهم يبدو وكأنه لا يهدف سوى إلى معاقبة نشاطهم في مجال الدفاع عن حقوق
الإنسان؛



*·          *وضع حد لسائر أشكال المضايقات التي تستهدف جميع الناشطين
المذكورين أعلاه، بما في ذلك على المستوى القضائي، وذلك بما يتوافق مع أحكام
إعلان الأمم المتحدة الخاص بالمدافعين عن حقوق الإنسان؛



*·          *ضمان الحق في محاكمة عادلة وتوفير الضمانات الأساسية لحقوق
الدفاع بما يتوافق مع المادة 14 (3) من العهد الدولي الخاص بالحقوق المدنية
والسياسية المصادق عليه من قبل الجزائر.



·          ضمان ممارسة حرية التجمع وتكوين الجمعيات والتعبير، بما يتوافق مع
الدستور الجزائري وأحكام العهد الدولي للحقوق المدنية والسياسية.

*Algeria: The Authorities Must Stop Harassing Labour Rights Activists*



*Copenhagen-Paris-Geneva, March 13, 2015* *– The Euro-Mediterranean Network
for Human Rights (EMNHR) and the Observatory for the Protection of Human
Rights Defenders, a joint programme of FIDH (International Federation for
Human Rights) and the World Organisation Against Torture (OMCT), denounce
the serious violations of the right to a fair trial during the last hearing
against nine activists of the National Committee for the Defence of the
Rights of Unemployed Workers (Comité National pour la Défense des Droits de
Chômeurs - CNDDC), held on March 11, 2015 in Laghouat (400 km south of
Algiers). *



On that day, an inordinate number of police officers were deployed, thereby
preventing the public and the witnesses for the defence to enter the
courtroom, which constitutes a violation of the rights of the defence and
the right to a fair trial. Outside the courtroom, the police arrested close
to 50 peaceful demonstrators who were expressing their solidarity with the
nine prisoners. All those demonstrators were released thereafter. As a
protest, the coalition of lawyers for the defence decided to withdraw. The
appeals hearing for Mr. *Mohamed Rag* has been postponed until March 18,
2015; the appeals hearing for the other eight activists, Messrs.* Khencha
Belkacem*, *Brahimi Belelmi*, *Mazouzi Benallal*, *Azzouzi Boubakeur*, *Korini
Belkacem*, *Bekouider Faouzi*, *Bensarkha Tahar* and *Djaballah
Abdelkader*, has
been scheduled for March 25, 2015



These activists were arrested on January 28, 2015 and sentenced by the
Laghouat Court of First Instance on February 11 to one year in prison with
a 6-month suspended sentence and a fine of 5,000 Algerian dinars for
*“gathering”* (Art. 97 of the Penal Code) and *“exercising pressure on the
decisions of magistrates”* (Art. 147 of the Penal Code). Mr. Mohamed Rag,
who has been in prison since January 22, 2015, was sentenced on that same
day to 18 months in prison and a fine of 20,000 Algerian dinars for
*“assaulting
a security force agent in the exercise of his duties”*, under Article 148
of the Penal Code. Our organisations have repeatedly denounced the
conditions of their arrest and detention, which seem to aim only at
sanctioning their human rights activities.



Our organisations also condemn the increase in the number of judicial
harassment cases which seem to single out other activists, in particular
Mr. *Rachid Aouine* and three other members of CNDDC in the city of El Oued
(620 km south-east of Algiers). Mr. Aouine was sentenced by the El Oued
Court of First Instance on March 9, 2015 to six months in prison and a fine
of 50,000 Algerians dinars for *“instigation of an unarmed gathering” *by
virtue of Article 100 of the Algerian Penal Code. He had posted a comment
on Facebook urging the police to stand up for their rights instead of
repressing the demonstrators. Mr. *Abdelhamid Brahimi*, who criticised the
El Oued police on Facebook for the brutal arrest of the members of Rachid
Aouine’s family whom had gathered peacefully on March 3 to call for
Rachid’s release, was arrested that same day and charged with *“instigating
a gathering”* on the basis of his comments on this social network. He was
finally released on March 9. Last, Messrs. *Ferhat Missa* and *Youssef
Sultani* were arrested on March 1 and 3, 2015 respectively, and then were
released. They will be judged on March 16 and 19 for *“instigating a
gathering”* because they participated in peaceful demonstrations in El Oued.



Our organisations call upon the Algerian authorities to:

·         Immediately and unconditionally release Messrs. Rachid Aouine,
Mohamed Rag, Khencha Belkacem, Brahimi Belelmi, Mazouzi Benallal, Azzouzi
Boubakeur, Korini Belkacem, Bekouider Faouzi, Bensarkha Tahar and Djaballah
Abdelkader, as their detention seems to aim only at sanctioning their human
rights activities;



·         Put an end to any act of harassment against all the
aforementioned human right defenders, including at the judicial level, in
compliance with the provisions of the United Nations Declaration on Human
Rights Defenders;



·         Guarantee the right to a fair trial and ensure a minimum
guarantee for the rights of the defence in compliance with article 14(3) of
the International Covenant on Civil and Political Rights (ICCPR), ratified
by Algeria.

·         Guarantee the right to freedom of assembly, association and
expression, in compliance with the Algerian Constitution and the provisions
of the ICCPR.
