 *A la frontière de l’inhumanité*

 *Des personnes réfugiées bloquées entre le Maroc et l’Algérie*

*Des personnes réfugiées de Syrie, parmi lesquels une vingtaine d’enfants,
sont laissés sans ressource depuis une semaine dans le désert non loin de
la ville de Figuig (Maroc). EuroMed Droits et ses organisations membres
alertent sur l’urgence de la situation, la nécessité d’une prise en charge
humanitaire et d’un accès inconditionnel à l’accueil et au respect des
droits de ces personnes.*



Plus de 60 personnes ont traversé la frontière algéro-marocaine le 18 avril
2017 pour rejoindre le territoire marocain. Onze d’entre elles ont été
expulsées le jour même : EuroMed Droits constate que ces personnes
réfugiées n’ont pu ou voulu faire entendre leur demande d’asile en Algérie,
et ont été refoulées du Maroc au mépris du principe de non-refoulement et
des garanties procédurales inscrites en droit marocain. Ces personnes sont
depuis laissées sans ressource en Algérie en violation de la convention de
Genève relative au statut des réfugiés.



Une cinquantaine de personnes restent, depuis, bloquées près de la ville de
Figuig (Maroc) sans ressource dans une zone désertique. Elles ne peuvent
s’appuyer que sur l’aide des associations et des résidents (eau,
nourriture, couverture). Au sein du groupe se trouvaient deux femmes
enceintes dont une a accouché en plein désert, sans soutien d’aucune sorte,
dimanche 23 avril.



Une fois de plus, la fermeture de la frontière et sa militarisation
entrainent des violations des droits, notamment le droit pour les personnes
réfugiées d’obtenir protection et de ne pas être pénalisées lorsqu’il
s’agit de franchir des postes frontières non habilités comme EuroMed Droits
le dénonce depuis plusieurs années.[1]



Si certaines personnes peuvent, selon nos sources, faire valoir un droit à
la réunification familiale au Maroc, EuroMed Droits souligne que toutes
relèvent du droit d’asile et peuvent, à ce titre, voir leur situation
examinée dans le cadre de la nouvelle politique migratoire mise en place
par les autorités marocaines.



Plus d’une semaine après l’alerte lancée par les associations sur la
situation, les conditions de survie imposées par les autorités marocaines
et algériennes à ces personnes réfugiées sont inhumaines et injustifiables.
EuroMed Droits rappelle que le droit international impose à tous les Etats
le respect inconditionnel du droit à la vie, au respect de la dignité
humaine, à la protection contre des traitements inhumains et dégradants,
ainsi que du droit au respect de l’intérêt supérieur de l’enfant. Chacun de
ces droits est bafoué.



EuroMed Droits et ses organisations membres appellent de toute urgence les
autorités marocaines et algériennes à assurer la protection des personnes
réfugiées dans le plein respect du droit international, et appellent de
toute urgence les autorités marocaines à permettre l’accès de toutes les
personnes maintenues à la frontière à des soins de santé approprié, à une
solution d’accueil pérenne, et à un examen le plus rapidement possible de
leur situation personnelle en vertu du droit d’asile.

*REFUGEES STRANDED BETWEEN MOROCCO AND ALGERIA*

*Refugees from Syria, including about twenty children, have been left for
over a week in the desert without any resources near the city of Figuig
(Morocco). EuroMed Rights and its member organisations stress the urgency
of the situation as well as the need for humanitarian support,
unconditional access to reception means for these people and respect of
their rights.*

On 18 April 2017, over 60 people have crossed the Algeria-Morocco border in
view of reaching the Moroccan territory. Eleven of them were deported back
the same day: EuroMed Rights notes that these refugees have not been able
or willing to claim asylum in Algeria, and that they have been deported
from Morocco in breach of the non-refoulement principle and in violation of
the procedural safeguards enshrined in Moroccan law. They have been left
without any resources in Algeria since then, in violation of the Geneva
Convention relating to the status of refugees.

Since then, about fifty people have been left alone, stranded at the border
in a desert area near the city of Figuig (Morocco), with no other support
than the help provided by non-governmental organisations and local
residents (water, food, blankets). Among them were two pregnant women, one
of whom has delivered birth on Sunday 23 April, with absolutely no support
whatsoever.

Yet again, the closure of the border and its militarisation has led to the
violation of human rights including refugees’ right to be protected and the
right not to be sanctioned for crossing borders at unofficial border
crossing points, a situation which EuroMed Rights has stressed for many
years.[1]

According to our sources, some of these people can avail themselves of the
right to family reunification in Morocco. Moreover, EuroMed Rights
emphasises that all of them fall under the scope of right of asylum and can
therefore see their situation examined, in the framework of the new
migration policy being established by the Moroccan authorities.

Over a week since non-governmental organisations alerted on the situation,
survival conditions imposed to these refugees by the Moroccan and the
Algerian authorities are inhumane and unjustifiable. EuroMed Rights recalls
that all States must abide by international law and therefore respect the
unconditional right to life and to human dignity, protect against inhumane
and degrading treatments as well as respect for the best interest of the
child. Each of these rights is being violated.

EuroMed Rights and its member organisations call on the Moroccan and
Algerian authorities to urgently provide protection to refugees in full
respect of international law, and urge the Moroccan authorities to allow
access to the required health care services, durable reception means to all
people held at the border, and to provide for the examination of their
individual situation based on asylum law as soon as possible.
