[EN] Joint statement / in English below: “*Must someone die for the
families stuck at the Algerian-Moroccan border to receive water, food, and
the protection they are entitled to? Our organisations call for an
immediate solution to be found, before it is too late.”*

This is the 4th press release from our part since this situation started on
17 April.

Other actions have included sending a letter to the ALG and the MOR
embassies (thank you to those of you who sent it in their organisation’s
name! *those who sent it please make yourself known to me* so we keep a
track of our action); sending a letter to the EU’s external action
services, and sending an emergency contribution to the Special Rapporteur.



We are now coordinating with the FIDH and Amnesty to reach out to the
Special Rapporteur on the human rights of migrants and to the UNHCR in
Geneva in the coming days. We will keep you posted. The situation is
desperate for people at this border and the local UNHCR are blocked. *Please
relay this statement widely*, including to the UNHCR office in your
country. I am afraid only pressure will push for a diplomatic exit in this
deadlock situation.



I take the opportunity of the email to express our solidarity with our
members in Algeria and Morocco acting relentlessly in solidarity with these
refugees, in a very tense context (military surveillance and intimidation,
arrests of refugees and migrants on the rise, as well as social uprisings
in the Rif region in Morocco on other matters addressed with much violence
by the authorities).

Vous trouverez ci-dessous le 4ème communiqué de notre part depuis le début
de cette situation de blocage à la frontière algéro-marocaine le 17 avril.

Nous avons également envoyé des lettres aux services extérieurs de l’UE,
une alerte au Rapporteur Spécial pour les droits des migrants, ainsi qu’aux
ambassades ALG et MOR (merci à celles et ceux d’entre vous qui l’ont envoyé
au nom de leur organisation ! *Merci à celles et ceux qui l’ont fait de me
l’indiquer *pour que nous gardions une trace de cette action).



Nous sommes en train de coordonner avec la FIDH et Amnesty pour tenter de
rencontrer le Rapporteur Spécial sur les droits humains des migrants et le
HCR à Genève dans les prochains jours. Nous vous tiendrons informés. La
situation est désespérée pour les familles bloquées à cette frontière. *Merci
de relayer ce communiqué largement dès à présent,* notamment aux bureaux du
HCR dans vos pays. J’ai bien peur que seule la pression permettra de
pousser en faveur d’une sortie de cette situation de blocage.



Je profite de cet email pour exprimer toute notre solidarité avec nos
membres en Algérie et au Maroc qui agissent en solidarité, sans relâche,
pour défendre les droits de ces réfugiés, dans un contexte extrêmement
tendu de part et d’autre (surveillance et intimidation militaire,
arrestations de réfugiés et de migrants notamment ces derniers jours au
Maroc, mouvement social et contestations dans le Rif au Maroc sur d’autres
sujets auxquels les autorités répondent par la violence).

due ? Nos organisations exhortent à une solution immédiate avant qu’il ne
soit trop tard.*



Les déclarations officielles du Ministère des Affaires Etrangères algérien
se déclarant prêt, le 2 juin, à accueillir les « ressortissants syriens »
pour des motifs humanitaires, sont restées sans application, ce qui fait
durer cette situation insupportable.



Malgré les fortes incertitudes quant au devenir véritable de ces personnes
dans un pays sans loi sur l’asile notamment, la situation semblait se
dénouer peu à peu, après la dénonciation par le plus haut niveau du
Haut-Commissariat aux Réfugiés (HCR) à Genève d’une « *situation dangereuse
et intenable* » le 31 mai dernier.



C’était sans compter sur les entêtements souverainistes d’Alger et Rabat.
Une délégation du HCR et du Croissant Rouge algérien a ainsi attendu
plusieurs heures, le 5 juin, au poste frontière de Béni-Ounif, sans que le
transfert (car c’est bien de cela qu’il s’agit), n’ait lieu sur fond de
conflit territorial larvé, et ce après que les forces marocaines se soient
rendues coupables de refoulement en arrêtant, en pleine ville de Figuig le
jour même à 6h du matin, une dizaine des réfugié.e.s pour les ramener dans
la zone tampon frontalière.



C’est donc toujours l’impasse alors que le groupe, joint hier après-midi
par téléphone, avait accepté d’entrer en Algérie même si leur souhait
demeure celui de rejoindre leurs familles établies légalement au Maroc ou
en Union européenne.



Alors que l’absence de dialogue  entre l’Algérie et le Maroc perdure, des
hommes, des femmes, et des enfants attendent depuis cinq jours que les
forces militaires des deux pays, qui ont pourtant renforcé la surveillance
dans la zone ces dernières heures, daignent leur apporter de l’eau et de la
nourriture. Personne ne semble pouvoir accéder aux réfugié.e.s : ni
médecin, ni HCR, ni association. Aucune aide humanitaire n’est prodiguée
par aucune des autorités. Même l’eau que des résident.e.s tentent de faire
parvenir depuis hier n’est jamais parvenue aux familles. La rivière toute
proche est, selon les réfugié.e.s, à sec.



Nous dénonçons les traitements inhumains et dégradants infligés par les
autorités des deux pays pour des motifs territoriaux, au mépris de leurs
obligations légales et morales. Nous exhortons les autorités algériennes et
marocaines à faire sortir immédiatement ces personnes de la zone hors droit
où elles sont maintenues arbitrairement, à les traiter dignement (eau,
nourriture, soins), et à leur donner un accès sans délai au HCR (Alger,
Genève, ou Rabat) afin qu’elles soient enregistrées et puissent entamer les
démarches nécessaire à leur accueil et au respect plein et entier de leurs
droits dans le pays d’asile de leur choix, y compris le droit à l’unité et
à la réunification familiale. Nous demandons enfin aux instances des
Nations Unies à Genève, en particulier les bureaux du HCR mais aussi le
bureau du Rapporteur Spécial des Nations Unies pour les droits de l’Homme
des migrant.e.s de maintenir leur engagement au plus haut niveau sur ce
dossier compte tenu de la gravité de la situation.



Nos organisations sont outrées que cet imbroglio territorial, incarné par
une militarisation croissante de la zone, conduise à en oublier les
principes les plus fondamentaux non seulement du droit, mais de l’humanité.
Cette situation, largement médiatisée et dénoncée, n’a que suffisamment
duré.

organisations call for an immediate solution to be found, before it is too
late.*

The Algerian Foreign Ministry’s June 2nd official statements announcing its
readiness to welcome the “Syrian nationals” on humanitarian grounds, have
not been implemented, turning this long lasting situation into an
unbearable state of affairs.

Since the UN High Commissioner for Refugees’ (UNHCR) high-level
denunciation of this “*untenable and dangerous situation*”, the issue had
seemed to be moving out of its previous impasse, in spite of substantial
uncertainty about the eventual fate of these Syrians in a country without
asylum laws.

Today, nationalist obstinacy on the Algerian and Moroccan sides is
hindering resolution of the situation. A joint delegation from the UNHCR
and the Algerian Red Crescent was kept waiting in vain for hours on June 5
at the Béni-Ounif border crossing, for the “transfer”—as inappropriate as
it is—to take place, in this latent conflict setting. Earlier that morning,
the Moroccan forces had committed an act of *refoulement* by arresting a
dozen men and women refugees in the centre of the Moroccan town of Figuig
at 6AM, and bringing them back into the buffer zone at the border.

The situation is thus at a dead-end while families, with whom we spoke on
the phone yesterday afternoon, have eventually agreed to enter Algeria,
even though their primary wish remains to reunite with those of their
family members legally established in Morocco or in the European Union.



For five days now, and in the absence of any dialogue between Algeria and
Morocco, women and children have been waiting for the military force to
provide them with water and food. The refugees are out of reach be it for
doctors, the UNHCR, NGOs or even water which local residents have been
trying to channel to families yesterday to no avail. No humanitarian aid is
being provided by any of the authorities. The river close by is dry, so
they report.



We hereby denounce the inhumane and degrading treatment which state
authorities willingly inflict on these people on territorial grounds and in
blatant breach of their legal and moral obligations. We urge the Algerian
and the Moroccan authorities to immediately take these people out of this
no-go zone where they are arbitrarily maintained, to treat them with
dignity (water, food, health care). We urge them to give these refugees
access to the UNHCR (Algiers, Geneva, Rabat) with no further delay so they
can be registered and engage the steps necessary to their reception, and
the full respect of the rights including family unity and family
reunification. Finally, we urge the United Nations in Geneva, in particular
the UNHCR as well as the Special Rapporteur on the human rights of migrants
to closely monitor and pro-actively involve at the highest level given the
seriousness of the situation.



Our organisations are outraged that this territorial dispute, materialised
by the growing militarisation of the area, is leading to the complete
oblivion of the most basic man as well as human principles. That’s enough
of a widely reported and denounced situation which has lasted too long.
